These Terms and Conditions govern your use, as a customer or diner (“you”), of the online ordering and reservation technology provided by Bontado (“us”, “we” or “our”) when you place an order or make a reservation with a restaurant that uses our system. By placing an order or reservation through a Bontado-powered ordering page, you agree to these Terms.
1. OUR ROLE
Bontado provides the technology that allows a restaurant to display its menu and accept your orders and reservations online. Bontado is not the seller of the food. Your order forms a contract between you and the restaurant you order from. The restaurant is solely responsible for the food, its preparation, packaging, pricing, and its fulfilment, whether by delivery or pickup.
2. PLACING AN ORDER
When you place an order, you select your items, choose an ordering method (delivery or pickup), and provide the details needed to fulfil it, such as your name, contact number and, for delivery, your address. Please make sure your details are accurate. Once the restaurant accepts your order, it will be prepared for delivery or pickup according to the information the restaurant provides.
3. PRICES AND PAYMENT
Prices, taxes, and any delivery charges are set by the restaurant and shown to you before you confirm your order. You can pay online through the restaurant’s connected payment provider or, where the restaurant offers it, pay in cash or at the store. Online payments are processed securely by third-party payment providers, and your payment goes to the restaurant, not to Bontado.
4. CANCELLATIONS, REFUNDS, AND COMPLAINTS
Because the restaurant is the seller, cancellations, refunds, missing or incorrect items, and complaints about your food or its delivery are handled by the restaurant in accordance with its own policies. Please contact the restaurant directly for any issue with your order.
5. YOUR RESPONSIBILITIES
You agree to provide accurate information, to be available to receive your order at the delivery address or pickup time you selected, and to use the ordering system lawfully — including not misusing it or placing fraudulent orders.
6. PRIVACY
The information you provide when ordering is used to fulfil your order. The restaurant you order from is responsible for your data as its controller, and Bontado processes it on the restaurant’s behalf to operate the ordering system. Please refer to the restaurant’s own privacy notice for details of how it handles your information.
7. LIABILITY
To the maximum extent permitted by law, Bontado is responsible only for providing the ordering technology and is not liable for the food you order or for its delivery, which are the sole responsibility of the restaurant.
8. CHANGES TO THESE TERMS
We may update these Terms from time to time. Any changes take effect when posted, and your continued use of the ordering system constitutes your acceptance of the updated Terms.
